(which is referred to in this document as the “Practice”) and/or any associated actions (such as, but not limited to, use of Instant Medical History to provide your medical information to the Practice), you accept these Terms of Use and Privacy Policy.  You further agree that such use signifies your assent and shall have the same legal effect as if you had signed these Terms of Use and Privacy Policy.  To the extent permitted by law, these Terms of Use and Privacy Policy are intended to supersede any provisions of applicable law that might otherwise limit its enforceability because it was signed electronically.

These Terms of Use and Privacy Policy apply to this website; any other website (and/or webpage on a website maintained by a third party) maintained by the Practice; each webpage maintained by the Practice; any and all social media used by the Practice to provide information and interact with patients, prospective patients, and the public; and any electronic communication with the Practice (including but not limited to email, text messages, social media postings, tweets, and/or all methods used in the present or future, whether currently known or later developed) (collectively called “Website,” “website,” “Websites,” or “websites”).

These Terms of Use and Privacy Policy may be updated or changed at any time without notice, effective upon posting.  Each time you use the website or any electronic services associated with the Practice, the most current Terms of Use and Privacy Policy apply.  We recommend that you check these Terms of Use and Privacy Policy often.


Medical Emergencies

NEVER USE THIS WEBSITE, EMAIL, A “CONTACT US” FORM, FACEBOOK, TWITTER, OR ANY OTHER ELECTRONIC OR SOCIAL MEDIA MEANS TO TRY TO COMMUNICATE WITH US ABOUT AN EMERGENCY.  Our websites and social media are not monitored often enough for use for any medical emergency or any urgent communications.


Minors

The content of our website is directed at adults, and therefore this Site is intended for use only by adults age 18 and older.  If you are under the age of 18, you should not use this website.


Electronic Communications and Medical Information

Email is NOT appropriate for communications about medical matters and/or Protected Health Information (“PHI”) because email’s security and privacy cannot be guaranteed.  Therefore, please do not use email and/or our website to communicate with us regarding medical matters or PHI, or to try to make, cancel, or reschedule appointments.  “Cancellation” by these methods does not constitute notice of cancellation.

The Practice provides the content on this website for information purposes only.  Whether or not you are a patient of the Practice, nothing on this website or any of our social media sites is to be considered, relied on, used as, or substituted for medical advice, diagnosis, or treatment.  We are not liable to any user or anyone else for any decision made or action taken by based on reliance upon the information contained or provided through this website or any of our social media sites. 

We advise you not to post anything of a sensitive or medical nature.  You expressly acknowledge and agree that you assume all responsibility related to the confidentiality and security risks inherent in sending any content over, or posting anything on, the Internet.  If you are a patient of the Practice, please be aware that even a seemingly innocuous or simple post to any of our websites or social media may reveal that you are a patient of our Practice.  Relevant comments on previously published posts are always welcome.  All postings must be courteous and respectful of all persons.  The Practice does not necessarily endorse, control or edit comments posted by third parties on our websites.  However, as explained below, we reserve the right to remove any post or comment at the Practice’s sole discretion.

Cookies, Tracking, and Website Statistics

We respect your privacy.  We do use Google Analytics to track and measure how users interact with our website’s content.  However, we understand (at the time of this writing in December 2015) that although Google Analytics uses cookies, Google Analytics does not store any personal information about our website users.  However, because we do not collect protected (personal) health information on our own website, Google Analytics does not even see your protected (personal) health information (PHI).  You may learn more about Google Analytics (including not limited to any changes Google may implement after this writing) at https://developers.google.com/analytics/devguides/collection/analyticsjs/cookie-usage?hl=en or Google’s other and possible future webpage(s) discussing this service. 
 

The Information We Collect

We collect information from patients and prospective patients electronically through Instant Medical History (“IMH”) and its website as described below.  If you plan to use our website to link to IMH’s website to provide medical history, medical information and/or protected health information (“PHI”), please read the separate notices (on 2 Webpages) which you will be presented prior to your use entitled “Why we Use Instant Medical History” and “Important Information about your use of Instant Medical History.”  Such information is not shared with any third-parties unless authorized by law in association with patient treatment in accordance with all health related regulations, or when ordered by a court to do so, or with your specific permission.  We also collect information to learn how users interact with our website’s content, as discussed in the section above, “Cookies, Tracking, and Website Statistics”. We do not collect your or anyone’s protected health information on our own website, so Google Analytics does not even see your personal or protected health information (PHI).
